Terms of Use — Blue Hole Design

These Terms of Use (“Terms”) govern your access to and use of the Blue Hole Design website (the “Site”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1) About the Site
The Site provides information about Blue Hole Design services and may allow you to contact us or request an appointment. The Site does not include a customer login area or payment portal.
2) Appointments and Inquiries
If you submit an inquiry or request an appointment through the Site:
- You agree to provide accurate, current information.
- Submitting a request does not guarantee availability or create a contract for services.
- Any project engagement, scope, timeline, and fees will be confirmed separately (for example, by email, proposal, or written agreement).
3) Acceptable Use
You agree not to use the Site in a way that:
- Violates any law or regulation
- Infringes the rights of others
- Attempts to gain unauthorized access to the Site or its systems
- Introduces malware, harmful code, or disrupts the Site’s operation
- Scrapes, crawls, or harvests data from the Site in a way that burdens or interferes with normal operation
We may restrict or block access to the Site if we reasonably believe misuse is occurring.
4) Intellectual Property
Unless otherwise stated, the Site content—including text, graphics, logos, images, layout, and design elements—is owned by Blue Hole Design or used with permission and is protected by intellectual property laws.
You may view, download, and print pages from the Site for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, or publicly display Site content without prior written permission.

9) Limitation of Liability
To the fullest extent permitted by law, Blue Hole Design will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Site.
In no event will Blue Hole Design’s total liability for any claim related to the Site exceed $100 (or the minimum amount permitted by law, if greater).
10) Indemnification
You agree to indemnify and hold harmless Blue Hole Design from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Site
- Your violation of these Terms
- Your violation of any rights of another person or entity
11) Changes to the Site or Terms
We may update the Site and these Terms from time to time. The “Effective date” at the top reflects the latest version. By continuing to use the Site after changes are posted, you agree to the updated Terms.
12) Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules.
